Monsanto Issues Not Addressed by
Manitoba Bill 10 Amending PBA

Bill 10, the Pension Benefits Amendment Act, has received both first and second reading in the Manitoba legislature. Although Bill 10 is the product of an extensive consultation process, it is unfortunate that the first comprehensive update to the Manitoba Pension Benefits Act (Manitoba PBA) in 20 years does not explicitly deal with issues raised by the Monsanto case. Although many of the planned amendments are aligned with changes already made by one or more pension standards jurisdictions and endorsed in the proposed CAPSA Model Law, a number of unique “made in Manitoba” solutions have been retained.
