Ontario Court Finds Federal Government Owns Pension Surplus
On November 20, 2007, the Ontario Superior Court of Justice released its decision in a pension surplus case: Professional Institute of the Public Service of Canada v. Canada (Attorney General). The Court held in favour of the federal government in a long-standing dispute between it and a group of its employees, represented by 17 employee associations. The Court held that the employer was entitled to use the $30 billion in surplus it had claimed over the past decade, making the financial aspect of this decision significant to the federal government. It is not yet known whether the employees will seek to appeal the Court’s decision.
