Court of Appeal Decision In Monsanto Released The long-awaited Ontario Court of Appeal decision in Monsanto stated that, under the Ontario Pension Benefits Act, surplus is payable on partial wind up. In light of this ruling, the outstanding question is whether the pension surplus reform provisions in Bill 198 will be passed or proclaimed by the Ontario government in their current form.Ontario Bill 198: New Rules For Surplus Withdrawal On Wednesday October 30th, 2002 Bill 198, Keeping the Promise for a Strong Economy Act (Budget Measures), 2002 received first reading in the Ontario legislature. Bill 198 is an omnibus budget bill which included amendments to the surplus provisions of the Ontario Pension Benefits Act (OPBA) in Part XXV (Sections 170-182). The Kirby Report: What Does It Mean For Health Care Plan Sponsors? The recently-released Report "The Health of Canadians - The Federal Role", more commonly known as the Kirby Report, contains a prescription for change that includes a national catastrophic drug insurance plan, new post-acute and palliative care programs. This Special Memorandum examines the pros and cons of some of the Kirby Report's recommendations for plan sponsors. However, the real question may be whether there is the public and political will to pay the estimated $5 billion price tag for the Report's recommendations, whether through a dedicated health tax or a health insurance premium. The final word on health care reform will not come until after the Romanow Commission report in late November, so it could be some time before plan sponsors have to take their medicine.
