British Columbia Court Allows Members To Terminate Their Pension Plan
On May 1, 2003, the British Columbia Supreme
Court released its decision in Buschau v. Rogers Communications Inc.
Pension plan members have, for the very first time, been successful in an action
to terminate their pension plan irrespective of the wishes of the plan sponsor.
This Special Memorandum summarizes the decision and discusses the potential
impact, including the significance for future surplus distribution cases across
Canada.
