Supreme Court Of Canada Grants Leave To Appeal In Monsanto
The Supreme Court of Canada (SCC) has announced that it will hear the appeal of the Ontario Court of Appeal’s ruling in Monsanto. If the appeal is unsuccessful, and the SCC confirms that surplus must be distributed on a partial wind up, many practical issues regarding the application of the decision will have to be clarified. The practice in other pension standards jurisdictions with similar legislation could also be affected.
